Your Rights

Miranda Rights are legal rights that must be read to a person upon their arrest, ensuring they are aware of their constitutional protections. These rights were established following the 1966 U.S. Supreme Court case Miranda v. Arizona and are designed to prevent selfincrimination during police interrogation.

The core elements of Miranda Rights include:

  • Right to Remain Silent: You are not obligated to answer questions or provide information to law enforcement. Anything you say can be used against you in court.
  • Right to an Attorney: You have the right to consult with a criminal defense attorney before and during questioning. If you cannot afford an attorney, one will be provided to you at no cost.
  • Right to Stop Questioning: You have the right to halt any questioning at any time, even after it has begun, if you wish to remain silent or consult with your attorney.
  • Understanding of Rights: After being informed of these rights, you must acknowledge that you understand them. You may then choose to waive them and speak voluntarily, but doing so could be detrimental to your case.

DUI / OWI Charges in Michigan

Michigan’s Legal Limits

Blood Alcohol Content (BAC) measures the alcohol in your bloodstream. For drivers over 21, the legal BAC limit is 0.08. For those under 21, it’s 0.02. Factors such as weight, gender, and drinking rate affect BAC levels, which can rise even after drinking has stopped.

Standardized OWI Tests

Standardized tests include:

  • Horizontal Gaze Nystagmus Test: Checks for eye twitching.
  • Walk and Turn Test: Measures balance and coordination.
  • Standing on One Leg: Assesses balance and cognitive function.

 

Are Sobriety Tests Mandatory?

Often times police officers want to administer a field sobriety test. These tests are voluntary and there is no penalty for refusing to take one.

Now, refusing a chemical BAC test—often referred to as a breathalyzer test, does carry significant licensing sanctions. If you refuse to submit to a breathalyzer test, you will be considered in violation of the implied consent law. A refusal is automatically submitted to the Michigan Secretary of State’s office. Then, you will have 14 days from the date of the refusal to contest the accusation.

Failure to respond within 14 days will result in an automatic six (6) points being added to your driving record and a one (1) year driver’s license suspension. If it is your second refusal within seven (7) years, you will face an automatic two-year license suspension and have no right to a hardship appeal.

Expungement for OWI

House Bills 4219 and 4220 provide an opportunity for those with a first OWI offense to seek expungement five years after probation ends, with certain exceptions.
